Court weighs if silence alone can invoke Miranda in Mich. case

WASHINGTON (AP) — The Supreme Court appears ready to tell suspects that if they want the right to remain silent, they have to say so.

The high court heard an appeal from Michigan prosecutors whose conviction was thrown out because police kept interrogating the suspect after reading him his Miranda rights, despite the fact that he never said he wanted to talk.

Lawyers for defendant Van Chester Thompkins’ argued that police must first get a suspect to say that he is waiving his right to be silent before an interrogation. But several justices indicated during arguments that they thought a suspect must first explicitly tell police that he wants to be silent before complaining about an interrogation.

Other justices said it was arguable that by remaining silent, Thompkins was invoking Miranda.


Bowling challenge slated for March 5

Thunderbird Lanes in Troy will be the site of the fifth annual bowling challenge pitting the New Lawyers Committee and the Oakland County Bar Association Board of Directors on Friday, March 5.

The event will begin at 6 p.m. with a portion of the proceeds designated for the NLC’s charity of choice, the Oak Park Business and Education Alliance.

The cost is $25 per person, $10 of which will benefit the Oak Park Business and Education Alliance. Thunderbird Lanes is located at 400 W. Maple, Troy.

NALS of Detroit presents its CLE After Hours with guest speaker attorney Linda Paullin-Hebden who will speak on “Pink Slip Today. . . Entrepreneur Tomorrow — A Guide to Starting Your Own Business” on Monday, March 8, with dinner at 6 p.m. followed by the presentation at 6:30 p.m. at the offices of Warner, Norcross, & Judd LLP in Southfield.

The cost to attend is $13 for NALS members; $15 for non-NALS members; and $8 for videoconference participants. Advance reservations are required and must be received by 5 p.m. on Friday, March 4.

Straker Bar presents 2010 Lawyer’s Toolkit at March 18 meeting

The D. Augustus Straker Bar Association will conducts the 2010 Lawyer’s Toolkit during its March Membership Meeting on Thursday, March 18, from 6 to 7:30 p.m. at Suite 1751 of the Bingham Office Center, 30800 Telegraph Road in Bingham Farms.

The meeting will provide guidance and tips for new and experienced attorneys. There will also be a drawing for a free “Basic Practice Handbook” from ICLE.
