California Feds sue security firm over complaint

SAN JOSE, Calif. (AP) -- Federal officials have filed a lawsuit accusing security firm Guardsmark of failing to protect an employee of Indian origin in San Jose from a co-worker, who allegedly taunted him about his accent, age and the turban he wore.

The U.S. Equal Employment Opportunity Commission said in the suit filed Tuesday that the company demoted 66-year-old Inderpal Nayyar after he repeatedly complained about the employee's behavior in 2007.

Nayyar later left Guardsmark. He had worked for the company, which has offices around the world, since 2005.

The suit seeks back pay and damages.

Guardsmark did not respond to a request for comment from the San Francisco Chronicle.

According to the EEOC, the company said it investigated Nayyar's complaint and found no indication of discrimination.
