Insurance & Indemnity Section to conduct Section Annual Meeting and Program

The State Bar of Michigan Insurance & Indemnity Section will host its Annual Meeting and Educational Program on Tuesday, October 27, from 3:30 to 5:30 p.m. online via Zoom. The business meeting will take place from 3:30 to 4 p.m. The educational program will begin at 4 p.m.

On June 29, the Michigan Supreme Court reversed longstanding precedent and held that unintentionally faulty subcontractor work that damages an insured’s work product constitutes an “occurrence” under a commercial general liability policy.  This year’s educational program, “When is faulty workmanship covered? Understanding Coverage for construction defect claims after Skanska USA Building Inc. v. M.A.P. Mechanical Contractors Inc. and Amerisure Mutual Ins. Co.,” will explore the impact that the Skanska decision will have on insurers and contractors alike.

Patrick Crandell, of Collins, Einhorn, Farrell PC, will discuss the historical treatment of insurance coverage for construction defect cases. He will address the policy requirement that damage be caused by an “occurrence” as well as the business risk exclusions that may apply to take away coverage if an “occurrence” is established.

Edward Bouchard, of Kotz Sangster, who represented Skanska before the Michigan Supreme Court, will walk attendees through the Skanska case and explain how the recent decision will impact insurance coverage for Skanska and other Michigan contractors.

Both speakers will provide their thoughts on what this decision will mean for insurers and contractors moving forward and \will be available for a virtual question and answer session immediately following the presentation.
