Judge orders road rage killing case to trial

HOWELL (AP) - A judge has ordered 69-year-old man to stand trial for murder in a case of alleged road rage in Livingston County. Derek Flemming was shot in the head in September after getting out of his vehicle to ask Martin Zale about his aggressive driving. It happened in Genoa Township, 45 miles northwest of Detroit. District Court Judge Carol Sue Reader ruled following a hearing last Friday that there is probable cause to send the case to Circuit Court. Flemming's wife testified at the hearing about seeing him collapse after being shot. Zale remains jailed without bond. An arraignment is expected in Circuit Court in the coming weeks. Defense lawyer Melissa Pearce has said she will argue self-defense. She says "the whole story has not been told." Published: Tue, Nov 25, 2014
