News (AP) - Conviction reversed by court in child-porn case

MUSKEGON (AP) -- The Michigan Supreme Court says someone who downloads or copies child pornography for personal use can't be charged with the more serious crime of making it.

The court reversed the conviction of Brian Hill, who had made that argument in Muskegon County court but lost in 2007.

In a 4-3 opinion, the court last Friday said the Michigan Legislature made a distinction between people who create and distribute child pornography and people who only possess it.

In a dissent, justices Robert Young Jr. and Maura Corrigan says the decision will relieve people of some criminal responsibility and create hurdles for prosecutors.
