Two Warner Norcross attorneys publish probate and estate guide

Two trusts and estates attorneys with Warner Norcross & Judd LLP are co-authors of the new Estates and Protected Individuals Code with Reporters’ Commentary.
John H. Martin and Mark K. Harder provided extensive commentary on EPIC and the new Michigan Trust Code, respectively, for the Institute for Continuing Legal Education guide.  The nearly 600-page volume provides a legislative history of the new bill, which goes into effect April 1, as well as further explanation of its meaning and how it should be interpreted by practitioners and the courts.
Both Martin, who is of counsel with the firm, and Harder, who is a partner, concentrate their practices in trusts and estates law.  From 1988-2000, Martin served as reporter for the EPIC drafting committee for the Council of the Probate and Estate Planning Section of the State Bar of Michigan.  He published the first edition of the commentary in 2000 and has published annual supplements since that time.
Harder chaired the State Bar of Michigan committee that spent more than five years writing the Michigan Trust Code, legislation that governs how trusts are established and administered in the state.  The Michigan Trust Code, which goes into effect April 1, 2010, both modernizes and provides uniformity for the law of trusts, filling in important gaps in the previous legislation.
Martin practices in the firm’s Muskegon office while Harder practices in the firm’s Holland office.
The Reporters’ Comment-
ary is all new for 2010, with the chapters on EPIC updated as modified by the new Michigan Trust Code.  Harder’s commentary on the new code, which was nearly seven years in the making, is all new for this edition.
