ABA calls for guidelines on judicial disqualification, disclosure of campaign support
The American Bar Association this week adopted policy calling on states to develop clear guidelines and procedures for judicial disqualification decisions, stricter rules on the disclosure of campaign support in judicial elections and prompt review of denials of requests to disqualify a judge.

The new policy also urges the ABA Standing Committee on Ethics and Professional Responsibility and the Standing Committee on Professional Discipline to fast track any changes to the ABA Model Rules of Professional Conduct regarding disclosure requirements and standards for judicial disqualification.

“This is a clear win for everyone who believes our judiciary should be a truly fair place where justice is delivered impartially,” said ABA President Stephen N. Zack.  “We are giving states the guidance they need to clarify the rules of the game so the public can have confidence in our system of justice,” he added.  “States are in the best position to determine how to adopt procedures for judicial disqualification.”

The ABA’s policy-making House of Delegates adopted the policy at the association’s Annual Meeting in Toronto.
