Heller presents at conference on legal malpractice in Chicago
Harvey R. Heller, shareholder at Southfield-based Maddin, Hauser, Wartell, Roth & Heller P.C., recently served as a panelist at the 12th Annual Legal Malpractice & Risk Management (LMRM) Conference in Chicago.
The conference is the nation’s premier event focused on developments in the law and litigation of legal malpractice claims, insurance and risk management strategies.
Heller served on the “Estate Planning – Recent Developments on Standing to Sue” panel. In it he, along with Connecticut-based Attorney Philip J. Tellerine and Tampa Attorney Marjorie Hensel, addressed the increasing threat of litigation estate practitioners face from beneficiaries, contingent beneficiaries and disgruntled heirs. They discussed the various state court views on the right of a non-client, who may be a beneficiary of a will or other testamentary document, to pursue a malpractice claim against an attorney who drafted the estate plan. Historically, such a claim required the existence of a lawyer/client relationship. This requirement has eroded in most states, allowing certain non-clients topursue the attorney.
The award-winning attorney has authored numerous articles on professional liability and often speaks at professional liability seminars.
A resident of West Bloomfield, Heller received his bachelor’s degree, with honors, from Michigan State University and his Juris Doctor, cum laude, from the Detroit College of Law. He is the leader of the firm’s Insurance Coverage and Defense Practice Group.
The Catholic Lawyers Society to host Lenten Evening of Reflection
