Drug conviction reinstated in case linked to perjury

DETROIT (AP) — A federal court has reinstated the drug conviction of a Detroit-area man whose case made headlines because of misconduct involving a judge, prosecutor and police officers.

In 2006, Alexander Aceval pleaded guilty in Wayne County court to cocaine possession. But he's been arguing in higher courts that misconduct at an earlier trial poisoned the entire legal process and should have insulated him from any prosecution.

A federal judge agreed, but an appeals court Monday overturned that decision and reinstated Aceval's guilty plea.

The plea occurred during Aceval's second trial. His first trial ended without a unanimous verdict. It was later revealed that a judge had allowed perjury at that trial.

A prosecutor and two Inkster officers were sentenced to jail for their roles. Charges against Judge Mary Waterstone were dismissed.
