LINCOLN PARK (AP) — A woman who was injured when she tripped on an elevated slab of concrete in suburban Detroit has won a key decision from the Michigan Supreme Court.
The court issued a unanimous ruling recently that Barbara Kozak had presented enough evidence to counter Lincoln Park’s argument that Kings Highway was safe and in reasonable repair.
There was a 3-inch difference in elevation between two slabs.
A Wayne County judge had ruled in favor of Lincoln Park and dismissed the lawsuit. But the Supreme Court says the city relied on an affidavit from a city employee who said the highway was
fine.
A resident said the road had been defective for about six years. The case now returns to Wayne County.
