Mid-winter meeting planned by SBM section

The State Bar of Michigan’s Labor & Employment Law Section will host its annual and mid-winter meeting on Friday, Jan. 24 at the Detroit Athletic Club.

Jim Obergefell from the Supreme Court case Obergefell v. Hodges will be the keynote speaker, and the Distinguished Service Award will be presented to Barry Goldman.

The education program and annual meeting will be followed by a cocktail reception and awards banquet .

Court overturns man’s murder conviction over Miranda rights

SALEM, Ind. (AP) — The Indiana Court of Appeals overturned the murder conviction of a man accused of setting a 2017 fire at his trailer that killed a homeless man, saying police “failed to scrupulously honor’’ his right to remain silent.

A jury found Joshua Risinger, 31, guilty but mentally ill last year.

The Salem man was accused of setting his trailer ablaze with 62-year-old Jeffery Givan inside.

Risinger told police he had invited Givan to stay with him.

In January, Risinger was sentenced to 60 years in prison.

Risinger appealed with several arguments, including that the trial court wrongly allowed statements he made to police where he said, “I’m done talking.’’

The appeals court agreed.

The three-judge panel said while Risinger could have been clearer in invoking his Miranda rights, the law doesn’t require such a formal declaration.

His statement was “an unequivocal invocation of his right to remain silent pursuant to Miranda, and the detectives continuation of questioning thereafter was a failure to scrupulously honor that right,” according to the Dec. 9 decision.

Deputies: Man stole car while another man slept inside

LAS CRUCES, N.M. (AP) — A New Mexico man is facing charges after authorities say he stole a car without knowing that another man was sleeping inside.

Joseph Allen, 40, of Las Cruces, New New Mexico, was arrested in connection with allegedly taking the running car in Vado, New Mexico, the Las Cruces Sun-News reports.

According to the Doña Ana County Sheriff's Office, Ignacio Baca, of Las Cruces, told authorities the episode began after he fell asleep in the back seat of his girlfriend's Toyota Corolla.

Baca said he had dropped off his girlfriend for work at a truck stop, and instead of going home, he parked the car and fell asleep.

Baca told detectives he'd left the vehicle running while he was sleeping, and later woke up and realized the car was traveling east on I-10.

Baca said he asked the man who he  was, and proceeded to punch and choke the stranger.

Allen regained control of the vehicle and pulled over, then pulled out a knife and slashed Baca on the left side of his rib as well as an arm, deputies said.

Baca eventually took the triple-edged knife from Allen, who then fled.

Allen faces facing several charges, including aggravated battery with a deadly weapon and auto burglary.
