Coronavirus prompts changes at Macomb courts

Macomb County Probate Court, in response to the COVID-19 outbreak, is only accepting  emergency filings and will only conduct emergency hearings, effective today and continuing until such time as the  state of emergency resolves.

All other currently scheduled hearings will be adjourned, except for the mental health dockets on Tuesdays and Thursdays.  The court will notify parties of the new hearing dates.

The emergency filings that will be accepted after today include the following:

  • Mental health pick-up/transport orders;
  • Other mental health petitions, including petitions for hospitalization;
  • Petitions for immediate funeral/burial arrangements;
  • Guardianships involving life-threatening medical emergencies;
  • Conservatorships with immediate pending evictions/foreclosures/shut off notices;
  • Estates where immediate access to a residence is necessary;
  • Requests for ex-parte temporary restraining orders;
  • Emergency petitions filed by Adult Protective Services.

Meanwhile, Chief Judge James M. Biernat has directed the following for Macomb County Circuit Court, effective immediately:

  • To the extent legally permissible, all motions/hearings should either be adjourned; be conducted remotely (via phone, polycom, etc.); or be decided on the briefs alone.
  • All arraignments for in custody defendants will be handled remotely by the chief judge.
  • Only necessary jury trials will be conducted until further notice.
  • All case evaluations will be conducted remotely.
  • All payments to the court should be made electronically or via U.S. Mail. No late fees will be assessed until further notice.
  • To the extent that any judge has adopted additional measures not inconsistent with these measures and permissible by law, judge-specific information will be available on each individual judge’s website.

Biernat said court officials will continue to review procedures and make changes to reduce the risk of transmission of COVID-19.

Federal court changes

The U.S. District Court for the Eastern District of Michigan has announced additional measures to prevent the spread of the Coronavirus Disease at its five courthouses in Detroit, Ann Arbor, Bay City, Flint and Port Huron.

Those changes include suspending naturalization ceremonies until further notice.

The measures take effect immediately are in addition to changes the court announced last week.
