Webinar to explore 'ADR in Divorce'

The American Bar Association will present the webinar “ADR in Divorce: Fast-Tracking Resolutions” on Monday, Sept. 20, beginning at 11 a.m. via Zoom.

Successful mediators have come to learn that truth is a critical element in any successful family and matrimonial negotiation. However, in an adversarial negotiation, trust is a relative thing.

One may never come to fully trust an adversary, but that doesn't mean parties can't mutually engage in a good faith and ethical negotiation process-a simple and honest approach that is often derailed by parties looking to gain an advantage. Too many good faith negotiations are sabotaged by parties using a variety of bad faith negotiation tactics, many of which are repeated all too often and can ultimately prevent a settlement.

The webinar’s panelists will provide tips on how to use Alternative Dispute Resolution (ADR) in matrimonial matters and family law disputes.

Attendees will learn the skills and tactics to ameliorate the situation and obtain a good faith settlement, as well as:

• When to use mediation, as well as the procedures involved.

• Why arbitration is an efficient and economical means of resolution and the issues that can and cannot be determined by an arbitrator.

• How the concept of a neutral is being utilized today.

• Other considerations, including when to begin mediation.

• Confidentiality and considerations in drafting the arbitration or mediation agreement.
