Defense Counsel Journal explores trending topics

Remote trial appearances, mediation in Mexico, and the use of independent taint teams to protect attorney-client privilege are topics covered in the latest edition of the Defense Counsel Journal (DCJ), published by the International Association of Defense Counsel (IADC).

The IADC’s third-quarter 2022 DCJ is available for free and without a subscription via the IADC’s website at www.iadclaw.org/documents/?CategoryId=4.

Frequently and favorably cited by courts and other legal scholarship, the DCJ is a quarterly forum for topical and scholarly writings on the law, including its development and reform, as well as on the practice of law in general. DCJ articles are written by members of the IADC, which is a 2,500-member, invitation-only, worldwide organization that serves its members and their clients, as well as the civil justice system and the legal profession.

Some of the articles in the journal include:

• “Out-of-State Witnesses: Are Zoom Trial Appearances a New Normal?” by Alaina N. Devine, a member at Campbell, Conroy & O’Neil, P.C. in Boston, Massachusetts – This article reviews recent decisions related to courts’ approach to Fed. R. Civ. P. 45 (c) in today’s age of Zoom and other forums for remote trial appearances.

• “The Historical Roots of Mediation in Mexico” by Manuel Moctezuma, a partner at Moctezuma Castro, S.C. in Mexico City – This piece reviews mediation in Mexico, providing valuable insight for anyone who may confront issues from drafting mediation clauses and settlement agreements to the mediation process itself.

• “Using Independent Taint Teams to Better Protect Attorney-Client Privilege” by consultant Richard Gregory, Managing Director William Marquardt, and Senior Managing Director Joseph Spinelli, all with J.S. Held’s Global Investigations practice in New York City – The article analyzes the flaws and procedural weaknesses of government taint teams and argues for independent taint teams to help protect attorney-client privilege and provide support to defense counsel and the court.
