McDonald Hopkins attorneys Miriam Rosen, Jim Boutrous, and David Schelberg will be speaking as part of a panel in a webinar presented by the Detroit Society for Human Resources Management (SHRM). “Dissecting the FTC’s Proposed Non-Compete Ban and Next Steps for Employers” will be presented online Thursday, March 9, from noon to 1 p.m.
National restrictive covenant attorneys Boutrous and Schelberg will cover the current state of the law related to restrictive covenants, the FTC’s proposed rule banning use of non-compete agreement, and steps that employers can take to protect their businesses and ensure that restrictive agreements are enforceable. Rosen will moderate this session.

Boutrous is the chair of McDonald Hopkins’ Labor and Employment Practice Group. He has non-compete and trade secret experience, which includes counseling, auditing and drafting agreements. His national restrictive covenant practice involves both prosecuting and defending employers in non-competition and trade secret litigation, with injunction hearing experience. He is recognized in the 2023 editions of The Best Lawyers in America and as a Michigan Super Lawyer.
Schelberg is a member in the McDonald Hopkins’ Labor and Employment Practice. He concentrates his practice on employment defense, representing employers in state, federal, and administrative matters involving claims of discrimination, retaliation, harassment. Schelberg also specializes in trade secret, non-competition, and non-solicitation litigation as well as counseling employers regarding a wide- range of employment matters and risk mitigation.
Rosen the managing member of McDonald Hopkins’ Detroit office and is a member of the firm’s Labor and Employment Practice. She focuses her practice on counseling employers on compliance with day-to-day and complex issues arising from state and federal employment laws.
