Protections under Michigan Constitution examined

The Criminal Defense Association of Michigan will present the webinar “MI>US: Improving Legal Protections for the Accused Using Michigan’s Constitution” on Friday, April 5, from 10 to 11 a.m. via Zoom.  

This session will focus on areas in which the Michigan Constitution varies from the United States Constitution and how to use those differences to a client’s advantage. Attendees will learn about recent decisions adopting or suggesting arguments for greater protections for the accused under Michigan’s Constitution, and how to most effectively litigate these issues.

Take-aways will include:

• Knowledge of recent decisions adopting or suggesting arguments for greater protections under Michigan’s Constitution

• Understanding of the legal standard Mich­igan’s courts apply when considering arguments to expand rights using Michigan’s Constitution

• The importance of being creative and persistent when litigating these law reform issues

• Tips for handling adverse controlling authorities

• The necessity of making these law reform arguments on state and federal grounds

Presenting at the webinar will be Sofia Nelson and Erin Van Campen of Neighborhood Defender Service of Detroit. In addition to working as a trial public defender, Nelson is the current chair of the Michigan State Bar’s Criminal Law Section. Van Campen is a research and training attorney, providing support to the Wayne County Assigned Counsel roster and the NDS staff. She also teaches Criminal Procedure at Wayne State Law School. They both have experience litigating creative law reform issues in Michigan’s appellate courts.

This training was inspired by recent successes using Michigan’s Constitution, such as the Michigan Supreme Court decision in People v Montez Stovall, a case litigated by Nelson.
