Nessel issues cease and desist order to pest control business for alleged consumer protection violations

Ecoshield Pest Solutions Detroit LLC (Ecoshield) has been told to cease and desist from engaging in unlawful business practices and amend its contracts to comply with the Michigan Home Solicitation Sales Act (HSSA) and the Michigan Consumer Protection Act (MCPA), Michigan Attorney General Dana Nessel announced Wednesday.   

The Department of Attorney General sent a notice of intended action to Ecoshield, which sells pest control services to Michigan consumers through a door-to-door solicitation model, after consumers complained to both the Attorney General and the Better Business Bureau.  

According to the HSSA, consumers have three days to cancel door-to-door sales contracts to receive a full refund. While acknowledging the three-day cancellation window, Ecoshield’s contracts allegedly include language attempting to waive consumers’ cancellation rights due to an alleged emergency as well as a customer’s rights to refunds for payments made for services rendered before a timely cancellation. Contracts also lacked the required notice of cancellation form.   

“With warmer weather comes an increase in door-to-door solicitors,” Nessel said. “Consumers have the right to take their time, ask questions, and avoid pressured on-the-spot decisions. Any deceptive tactics should be reported to my office.”  

If Ecoshield fails to comply with Michigan law, the Attorney General may pursue a formal investigation or litigation under the MCPA.
