Michigan’s DRE program focus of webinar Sept. 19

The Prosecuting Attorneys Association of Michigan will present the Traffic Safety Training Program Webinar “Michigan’s DRE Program: Moving Past People v. Bowden” on Thursday, September 19, from noon to 1 p.m. via Zoom.

In Michigan, a DRE’s ability to provide an expert opinion under MRE 702 has been limited by the 2022 Michigan Court of Appeals decision People v. Bowden. 

The decision though should not stop prosecutors from moving forward with critical DRE testimony in drugged driving cases.  It is important that prosecutors understand how a DRE can still help establish impairment in a drugged driving case through expert testimony that is consistent with the Bowden decision.  

This webinar will go over what the Court of Appeals held in the Bowden decision, the 2023 State of New Jersey v. Olenowski decision dealing with DRE testimony and Daubert, how DRE officers can be used in helping prove a drugged driving case that is consistent with Bowden, and what resources are available to prosecutors and DRE officers to handle DRE testimony in court.
