Trial ordered in fatal shooting over dog dispute
NOVI (AP) - A district court judge says a 28-year-old Iraq war veteran will stand trial for the death of a neighbor, who was shot during a dispute over a lost dog.
Marine veteran Charles Simkins of Walled Lake is charged with an open count of murder in the Dec. 17 shooting of 45-year-old Ed Criswell.
Authorities say that Simkins and Criswell got in a fight about Simkins' beagle, which had been running loose.
Novi District Court Judge Dennis Powers ruled Tuesday that there's enough evidence to send the case to trial, but she says prosecutors can't use Criswell's videotaped confession during the trial because he made it clear he wanted a lawyer first.
Simkins remains jailed without bond.
