MARQUETTE, Mich. (AP) - A road commission in Michigan's Upper Peninsula is asking a judge to reconsider his decision to dismiss a lawsuit against the federal government over a road and wetlands.
The Marquette County Road Commission had proposed to fill 25 acres of wetlands to build a road that would provide a more direct route for trucks between a mine and a processing mill.
But the U.S. Environmental Protection Agency raised objections over the impacts. State regulators didn't issue a permit in 2013 and sent the matter to the U.S. Army Corps of Engineers. The county declined to apply again.
Federal Judge Robert Holmes Bell said Marquette County doesn't have a viable claim against the EPA. In a filing Monday, the county says Bell erred in his analysis and wants him to reconsider.
