Rules of evidence and hearsay

The Oakland County Bar Association presented “Can You Say that Again? An Analysis of MRE 801 and MRE 804” on Thursday, Jan. 30, at the OCBA offices in Bloomfield Hills. Michigan Rules of Evidence 801 and 804 set forth the definition of hearsay and the exceptions to the Hearsay Rule when a witness is unavailable.  Attorney Michael J. McCarthy (pictured), of Michael J. McCarthy PC, offered an analysis of Michigan’s Hearsay Rule and practical pointers on offering statements into evidence when the declarant cannot or will not testify in court.
