The Michigan Supreme Court announced on Thursday that its upcoming special session of oral argument, originally set for September 2, has been rescheduled to Wednesday, September 9, 2020. The court will be hearing argument in In re Certified Questions from the U.S. District Court.
Statement from Justice Richard H. Bernstein regarding the delay:
“Since an indispensable member of my team was diagnosed with COVID-19 a week ago and is struggling, I very much appreciate the cooperation of my colleagues in delaying the important oral argument regarding the certified questions from federal court. Because of my blindness, I depend on him to help me review and internalize thousands of pages of material. This review process includes state and federal constitutions, state statutes, legislative history, previous court rulings, and the many filings by the parties and friends of the court. The work he does with me takes extensive time and effort and cannot be done without him. As a former college athlete, he doesn’t stop for anything, but the symptoms of this illness are slowing him down. We have been working remotely since March and have kept up with the many cases the court addressed through the end of the term. However, now our work has been delayed, and we are focused on getting ready for September 9.”
The court will convene this special session at 9:30 a.m. via Zoom, and attorneys for the parties have all agreed to argue their cases via Zoom.
The oral arguments will be live streamed, recorded, and later archived on YouTube.
