Reordered law enforcement priorities top agenda at next month’s ABA white-collar crime meeting

White collar defense attorneys, federal and state prosecutors, corporate counsel and compliance officers, judges and academics will meet Sept. 3-5 at the American Bar Association Criminal Justice Section’s 11th Annual Southeastern White Collar Crime Institute  to discuss emerging law enforcement trends, public corruption, international bribery and other pressing issues in the industry.
Throughout its 10-year history, the meeting, held this year at the Chateau Élan Winery & Resort in Braselton, Ga., has evolved to reflect shifting enforcement priorities and policy developments across federal law enforcement agencies.

Program highlights include:

• “Fireside Chat” — “Quiet Counsel” author and former Deputy Attorney General Larry Thompson will share insights from his career, including highlights from his time as a partner at King & Spalding, his role as U.S. attorney in Atlanta, his role as deputy attorney general, his role as PepsiCo general counsel and his role leading the U.S. Department of Justice National Security Coordination Council.

• “Significant National & Regional Developments in the New DOJ Administration: Former U.S. Attorneys Roundtable Discussion” — This roundtable of former U.S. attorneys will address the white-collar enforcement priorities in the current administration. 
Panelists will also discuss the latest trends and initiatives that the Department of Justice is pursuing nationally in cybersecurity, corporate fraud, health care fraud, public corruption and other white-collar criminal enforcement areas.

• “Health Care Fraud and the New Administration” — The Trump administration has reordered enforcement priorities, but health care fraud enforcement remains an important strategy for addressing “fraud, waste and abuse.” 
This panel will discuss the changing focus of criminal and civil health care fraud enforcement and continuing developments in the application of the False Claims Act. 
The panel also will examine traditional enforcement actions that have always been in play and are expected to continue in the current administration.

• “Navigating New Boundaries: Recent Supreme Court and Appellate Court Decisions Shaping White-Collar Crime” — This panel will explore the evolving landscape of white-collar crime through the lens of recent U.S. Supreme Court and federal appellate court decisions. 
Focusing on landmark cases from 2023 to 2025, including Kousisis v. United States, Ciminelli v. United States, Percoco v. United States and others, the discussion will examine how these rulings have redefined the scope of federal fraud statutes, such as wire fraud and honest-services fraud and their implications for prosecutorial discretion and defense strategies. 
Key topics include the rejection of the “right to control” theory, limitations on honest-services fraud and the impact of decisions such as United States v. Snyder on bribery statutes.

• “Trends in Fraud Enforcement” — Fraud enforcement by the Trump administration and the Department of Justice as set out in executive orders, Attorney General Pam Bondi memoranda and in the speeches and memos of key DOJ personnel is charting a new course for white-collar enforcement in the United States and around the world. 
For example, traditional leadership by the DOJ in the enforcement of the Foreign Corrupt Practices Act has been deferred to other countries, international bodies and some activist state attorneys general.
The panel will examine the short- and long-term impact of these changes on corporate America and its allocation of time and money to compliance as well as on voluntary disclosures and the role of whistleblowers and the “qui tam relators” bar and whether there will be more utilization of the False Claims Act against fraud in government contracts and in healthcare.
