Speakers discuss Presentence Investigation and Report

The State Appellate Defender Office invites attendees to the State Bar of Michigan’s Prisons and Corrections Section’s Spring Conference, titled “The Presentence Investigation and Report (PSIR),” online Friday, June 21, from 9 a.m. to 1:30 p.m. via Zoom.

This training will look into everything about the PSIR, how to prepare a client for the interview, and how the Michigan Department of Corrections utilizes the report.

Topics to be covered include:

• MDOC PSI Policy and Procedure and Michigan Court Rules, presented by Jacqueline Gallant from the MDOC

• Post-Conviction and PSI Interviews. A run through of the new court rule, MCR 6.425(A)(2), allowing attorneys to be present at the PSI interviews, preparing a written offense statement, assisting clients with preparation of the PSI workbook and gathering documents for the interview, presented by attorney Jill Price

• At sentencing, the objections to the PSIR, MCR 6.425(B)-(E). How to make objections to the PSIR, including guideline scoring and the best practices for attorneys at sentencing, presented by attorney Michael McCarthy

• Sentencing memorandum & mitigation evidence for sentencing and resentencing hearings. What belongs in the defense counsel’s sentencing memorandum and a discussion of mitigation evidence, MIDC money, and resources available, presented by attorney Rachel Wolfe and Mitigation Specialist Emily Swanson from MAACS

• Shining a Light on How the PSI is Used in the MDOC, presented by a MDOC RGC expert—Kyle Kaminski.
