State Supreme Court to consider new rule
requiring judges to inform defendants of
right to withdraw plea

The Michigan Supreme Court is considering a new rule requiring judges to inform defendants prior to accepting their plea of guilty or no contest of their right to withdraw the plea.

The proposed new court rule also would declare defendants could not withdraw their plea if they engage in misconduct prior to sentencing unless the judge allows for good cause, nor would the judge have to abide by any sentencing agreement or evaluation.

Justice Brian Zahra, in a dissent, said he would have declined to publish the proposal for comment.

The current Michigan Court Rules provide that defendants pleading guilty or no contest be asked whether the plea is voluntary and accurate, understand the nature of the offense to which they are pleading, agree they are giving up some appealable right, among other items.

Comments on the proposal are due by January 1, 2025.
