Since the advent of medical marijuana in 2008 under the Michigan Medical Marijuana Act (MMMA), and the subsequent legalization of recreational marijuana under the Michigan Regulation and Taxation of Marijuana Act (MRTMA) in 2018, the ever-changing statutes and case law surrounding marijuana have confounded and confused both officers and prosecutors throughout the State of Michigan.
This confusion has led to many myths about whether marijuana offenses can even be prosecuted in the State of Michigan under the Controlled Substance Act or the Michigan Motor Vehicle Code. However, through a better understanding of the statutes and the most recent case law surrounding MRTMA, many of those myths can be dispelled. In this course, topics will include:
• An in-depth analysis of the Michigan Regulation and Taxation of Marijuana Act (MRTMA), including what the Act allows and does not allow and the various punishments
available under the MRTMA, the Controlled Substance Act, and the Motor Vehicle Code.
• An analysis of what options are available to officers during a roadside traffic investigation once they encounter the odor of marijuana during their roadside investigation.
• A review of recent case law surrounding the Fourth Amendment, as it pertains to marijuana investigations conducted roadside, including developing probable cause to search a motor vehicle, if a violation of MRTMA or the Controlled Substance Act is suspected.
• A review of how officers can detect marijuana impaired driving, and what prosecutors will need to prove in court as it relates to marijuana impaired driving.
