The Universal Periodic Review is a unique mechanism in which every U.N. Member State, large and small, undergoes a peer review of its human rights record. Since the UPR’s creation in 2006, the United States has consistently participated, recognizing that accountability and open dialogue strengthen our democracy. When the United States participates in this process by presenting its own progress, acknowledging shortcomings and responding to recommendations from other nations, the United States demonstrates both confidence in its constitutional system and leadership on the global stage.
Declining to appear before the council sends a troubling signal. It risks diminishing the credibility of the United States in advocating for human rights abroad and may embolden those who seek to avoid scrutiny of their own records. It also denies our citizens, civil society and government the opportunity to showcase the progress the nation has made in areas ranging from criminal justice reform to the protection of fundamental freedoms.
The ABA has long held that respect for the rule of law and engagement with international institutions are vital to advancing human rights globally. Participation in the UPR is an affirmation that the United States is prepared to hold itself to the same standards it asks of others. Participation is not an endorsement of every action of the Human Rights Council.
Transparency, accountability and constructive engagement are the hallmarks of a just society.
For these reasons, the ABA urges the administration to reconsider its decision and to fully participate in the UPR process. Doing so will reaffirm our nation’s commitment to human rights. The world looks to the United States for leadership. That leadership begins with our willingness to subject ourselves to the same principles of fairness, openness and accountability that we ask of others.
