ABA President Michelle Behnke discusses election integrity on 100th episode of Litigation Radio Podcast

Tune in to the 100th episode of the American Bar Association Litigation Radio Podcast on Tuesday, May 19.

Host James Arthur Reeder Jr., former chair of the ABA Litigation Section, sits down with ABA President Michelle A. Behnke for a conversation about the U.S. election system and the role lawyers can play in safeguarding that system. 

The ABA, with Behnke leading the way, has maintained that “fair and equal access to the ballot is fundamental to the rule of law.”

During the podcast, Behnke weaves in tips and advice for lawyers, as the nation approaches election season and answers questions, such as:

• Should we trust the election system?
• Where are the risks, and how serious are they?
• How transparent is the process?
• Mail-in voting, what happens to the ballots?
• What can lawyers do to inspire trust in the system?

Behnke offered some reassuring evidence supporting the integrity of the election system and detailed her experiences as a poll watcher and worker, which contributed to her confidence in the system.

Behnke said assertions that the system is overrun by illegal voters “is overblown and used as a weapon to scare people when in reality the system is incredibly safe.”

She encouraged lawyers to volunteer as poll workers and to go out in the community and explain and defend the election system.

“If we leave questions and concerns unchecked, then the system starts to deteriorate,” Behnke said.

The ABA continues to keep lawyers abreast of the changes involving voting rights and redistricting, releasing a statement from Behnke, “Fair and equal access to the ballot is fundamental to the rule of law,” on May 11.
