Hearing set for proposed court rules changes

The Michigan Supreme Court will hold a public administrative hearing on Wednesday, Sept. 20 in Lansing on various proposed amendments to Michigan Court Rules.

The hearing will be held starting at 9:30 a.m. in the Supreme Court courtroom located on the sixth floor of the Michigan Hall of Justice, 925 W. Ottawa St.

Those wishing to address the court regarding matters on the agenda will be allotted three minutes each to present their views, after which the speakers may be questioned by the justices.  

Comments offered at a public hearing must pertain directly to an item on the public hearing agenda. 

To reserve a place on the agenda, notify the Office of Administrative Counsel in writing at P.O. Box 30052, Lansing, 48909, or by e-mail at ADMcomment@courts. mi.gov, no later than Sept. 18.

The administrative matters on the agenda for this hearing are:

• 2015-11 Proposed Amendment of MRE 404(b).
Issue: Whether to adopt the proposed amendment of MRE 404(b)(2) to require the prosecution to provide reasonable notice of other acts ­evidence in writing 14 days before trial or orally in open court on the record.

• 2015-15 Proposed Amendment of MCR 6.425.
Issue: Whether to adopt the proposed amendment that would explicitly require court-appointed appellate counsel and trial courts to follow procedures set forth in Anders v California, 386 US 738 (1967), before allowing counsel for plea-convicted indigent defendants to withdraw from representation based on frivolousness of the appeal.

• 2016-12 Proposed Amendment of MCR 3.206
Issue: Whether to adopt the proposed amendment that would strike the language “and dates of birth” to protect personal information from being accessible from court records.

• 2016-41 Proposed Amendments of MRPC 1.0, 1.2, 4.2, and 4.3, and MCR 2.107, 2.117, and 6.001.
Issue: Whether to adopt the proposed amendments that would establish explicit rules for limited scope representation (LSR).

• 2017-06 Proposed Amendment of MCR 7.300 et seq.
Issue: Whether to adopt several follow-up MSC court rule revisions.
