‘Electronic Communication Risks in the Attorney-Client Relationship’ explored July 10
American Law Institute Continuing Legal Education will present the webcast “Ethics, Unplugged: Electronic Communication Risks in the Attorney-Client Relationship” on Thursday, July 10, from noon to 1:30 p.m.
Digital communication is embedded in every aspect of legal practice—from client intake to courtroom strategy. But with speed and convenience come ethical landmines. This program examines the evolving ethical landscape attorneys face in the digital age, with a focus on how electronic communication methods — such as email, texting, social media, and cloud-based platforms — intersect with professional responsibilities.
Ethics authority Thomas Spahn explores the blurred lines between digital communication and legal ethics. This session unpacks the challenges lawyers face when navigating emails, metadata, social media, cloud storage, multijurisdictional practice, and more. By the end of this program, participants will be able to:
• Identify how and when attorney-client relationships can be unintentionally formed via electronic communications.
• Apply confidentiality, competence, and supervision duties to modern forms of communication, including cloud storage, mobile platforms, and metadata.
• Recognize ethical challenges related to multijurisdictional and virtual practices, and implement best practices to mitigate risk.
• Evaluate the propriety of investigative practices involving jurors, witnesses, and judges through social media.
• Understand the ethical implications of inadvertent disclosures and the transmission of privileged information electronically.
