Appeals court throws out lawsuit by man cleared of 1992 murder

HAMBURG TOWNSHIP, Mich. (AP) - A southeastern Michigan man who spent years in prison for a 1992 killing before his murder conviction was overturned has lost his damage claims against police. Daniel A. Newman filed suit in Detroit U.S. District Court in 2012 against Livingston County's Hamburg Township and two police officers, accusing them of malicious prosecution. A judge dismissed the township and one officer as defendants, allowing the case to proceed against Sgt. Eric Calhoun. Calhoun asked the 6th Circuit U.S. Court of Appeals to dismiss him as a defendant, and the Cincinnati court ruled in his favor Dec. 12. The 47-year-old Newman was convicted in the robbery-shooting of Harvey Chappelear in Hamburg Township.
