New court rules on presidential elections finalized

The Michigan Supreme Court issued an order Wednesday setting the court rules on how challenges to the results of a presidential election will be handled.

The changes, adopted unanimously, are designed to bring the Michigan Court Rules into compliance with PA 269 of 2023 and PA 255 of 2023, which altered the process for transmitting Michigan's presidential election results to the federal government and challenges to the race for the state's electoral votes.

PA 269 set up a mechanism for the Supreme Court to review the results of a recount for Michigan's electoral votes that produced a different result than the original count. PA 255 establishes a process for the Supreme Court to address a challenge to the certified presidential election vote.

Most of the order simply reflects the statute.

But it also spells out filing mechanics, who must receive service of the complaint, how and when notices to intervene must be filed and timing of reply briefs
