Prosecutors discuss Michigan’s newest weapon against drunk driving

The Prosecuting Attorneys Association of Michigan will present the Traffic Safety Training Program Webinar on “TSTP-1-9000: Michigan’s Newest Weapon Against Drunk Driving” Thursday, August 28, from noon to 1:30 p.m. via Zoom.

The lntoxilyzer 9000 is Michigan’s newest weapon in the fight against drunk drivers. These breath testing instruments are maintained by the Michigan State Police and have now replaced all Datamaster DMT instruments in the state. Prosecutors handling operating while intoxicated (OWi) cases involving breath test results must be familiar with the lntoxilyzer 9000 and its administrative rules to successfully introduce breath test results at trial and effectively rebut any defense challenges that may arise.

This webinar will cover the following topics:

• Overview of Michigan’s Implied Consent Law.

• Procedure in administering a breath test on the lntoxilyzer 9000 instrument.

• Case law surrounding breath tests.

• Foundational requirements for the admission of lntoxilyzer 9000 breath test results.

Speaking at the webinar will be Michigan Traffic Safety Resource Prosecutors Kinga Canike and Eric Wanink.
