The Oakland County Bar Association will present “High-End Residential Construction: Pitfalls, Challenges and Legal Solutions” on Tuesday, Feb. 26, from 5:30 to 7 p.m. at the OCBA offices in Bloomfield Hills.
Presenters will include Lawrence M. Dudek of Miller, Canfield, Paddock, and Stone PLC; along with Jim Schmid, founder and managing director of Resolution Experts PC. They will use real-life case studies to cover legal issues to consider when representing the high-end residential and commercial construction client.
Topics of discussion will include:
• Structuring the relationship using proper project delivery mechanisms and key contract provisions.
• Problems to anticipate and suggestions for mitigation: fraud and overbilling, compliance with quality expectations and schedule expectations.
• The importance of project documentation, document retention, and your right to audit project records.
• Dealing with the project in distress.
• Understanding market norms and bargaining strengths and weaknesses.
• Roles of the construction lender, title agency and title insurer.
