Effective witness selection, preparation, and related motion work are instrumental components of a winning case strategy. Effective witnesses know their case, are well-prepared, and equipped with the tools needed to persuade the court in your client’s favor. Moreover, impactful expert testimony has the power to motivate settlements before a court date.
Unprepared expert witnesses have equally influential power over your case – once they take the stand or offer a bad report as evidence it becomes almost impossible to repair.
This webinar presentation will discuss the strategy and mechanics behind deciding whether an expert witness is needed, retaining an expert, and working with the expert
constructively so that the expert adds value to your case and aids your litigation strategy. Topics to be covered include:
• Deciding whether you need an expert witness and on what topics – the most important factors to consider.
• Finding an expert, scoping their opinion, and complying with applicable rules on expert discovery.
• Understanding how to work with your experts in crafting helpful opinions and reports.
• Preparing experts for rebuttal reports and for depositions.
• Fending off pre-trial motions focused on expert discovery, including Daubert motions.
• Preparing experts for an effective direct examination and cross-examination at trial.
