Lifeguards sued in wave pool death are cleared
ROCKWOOD, Mich. (AP) -- The Michigan appeals court has dismissed a lawsuit against lifeguards who were accused of gross negligence in the death of a woman at a Detroit-area wave pool.
The court overturned a decision by Wayne County Judge Michael Sapala. Lisa Cox of Lincoln Park drowned three years ago at the Lake Erie Metropark wave pool in Rockwood.
The appeals court says lifeguards didn't see the 20-year-old Cox until other swimmers brought her to the surface. Lifeguards then scrambled to get the proper equipment and clear the area before starting CPR. The court says that's not gross negligence.
The medical examiner says Cox's drowning was brought on by seizures.
